Other Mississippi Expungement Statutes:
41-29-150: Allows anyone who has plead or been found guilty
of a drug-related charge and the court withheld judgment and
allowed said individual to complete a program (like drug court or
treatment) may have the charge and any documentation related to
their arrest, indictment or trial removed from their record.
99-19-71: Misdemeanor Expungement: Any person who is
convicted of a misdemeanor (EXCLUDING A TRAFFIC VIOLATION)
and is a first offender may petition the appropriate court for an
expungement of their record.
99-15-26: Any charge in a Felony or Misdemeanor case in which
there was no conviction or a non-adjudication may be expunged
(except crimes against the person and embezzlement while in
public office may not be non-adjudicated). This section also says
that DUI Convictions and Drug Sale (or other distribution related
charges) CANNOT BE EXPUNGED.
Mississippi Constitution Article 5 Section 124: Pardons by the
Governor are available to those convicted of misdemeanors or
felonies (treason and impeachment excepted). The Office of the
Governor must be petitioned and if the charge in question is a
felony, the petitioner must publish the reason(s) a pardon should
be granted in their local paper for a period of thirty (30) days.
Felony Expungements in Mississippi:
On July 1, 2010, some people who have been convicted of a felony
are eligible for an expungement. Mississippi Code Section 99-19-71
has been amended and allows the following crimes to be expunged
from their record:
1. Bad Check Offenses (under Sec. 97-19-55 )
2. Poss. of a Controlled Substance (under Sec. 41-29-139 (c))
3. Possession of Paraphernalia (under Sec. 41-29-139 (c))
4. False Pretenses (under Sec. 97-19-39)
5. Larceny (under Sec. 97-17-41)
6. Malicious Mischief (under Sec. 97-17-67)
7. Shoplifting (under Sec. 97-23-93)
Only one felony may be expunged from one's record and those
requesting an expungement MUST have successfully completed all
terms and conditions of their sentence and maintained good
behavior for a period of five (5) years since the completion of the
sentence.
